Fuck this state!!! fuck law enforcement!!! they have turned this state into a place where u have to be almost afraid to go out on the road!! im serious there are soo many cops its pathetic and they have to justify their jobs by writing tickets for any and every little thing they can find!! ill beat this if i have to spend every dime i have!! so much for that nice gh run i had planned... what a bunch of assholes!!!

Get an attorney because your case can be easily won. In order for a DWI to stick in court, the cop has to show proof that you were driving, via the dash cam. If the dash cam shows you just sitting in your car, then your attorney will just file a motion to supress that evidence, which HAS to be granted by the judge. Now if you sumbitted to a breathalyzer then you are fucked. Never take a breathalyzer or field sobriety test, just tell them to take you to jail and book you on suspicion of DWI.

I say that because I got into an accident after drinking and it was raining. The dash cam showed the cop pulling up behind me, arresting me on suspicion, and that's it. My attorney supressed the video, the case was dismissed on lack of evidence because I refused the breathalyzer and sobriety test. It cost me 4 grand, but a DWI ends up costing you between 10 and 20 grand after fines, classes, license reinstatement, insurance increase, etc.

u refuse a breathalyzer in ny and u automatically lose your license for a year! that is a fact!

Loosing your license for a year is better then having a DUI on file though.
Also if by slim chance you are diebetic you maybe able to get off because of that. Bllood sugar levels read the same as Alcohol levels. Thats how alot of DUI's are beaten. Also, it helps to have a Firefighter badge on your license plate

ha thanks for all the advice guys... but i cant look back anymore at what i could have done different... i got the best lawyer in ny state so illl let him deal with this and we'll see how i make out!
